En gigante asiático ha aprobado en su decimotercera «Asamblea Nacional del Pueblo» el primer Código Civil de su historia (como se hacen eco nuestros colegas de IPKitten). Son más de cien años en los que se había intentado-en más de cuatro ocasiones-promulgar un único Código Civil sin éxito. Su entrada en vigor está prevista para el 1 de enero de 2021.
El máximo dirigente Chino, Xi Jinping se ha felicitado por la aprobación de la «primera ley que lleva el nombre de «código» en China» puesto que es un paso muy importante para el país.
Del Código Civil Chino («C.c.C.») destaca que se ha optado por no codificarla normativa de propiedad intelectual es éste, a pesar de que en los borradores si se incorporaba algún artículo-123-y que cierta parte de la doctrina del país especialista en la materia venia reclamando su incorporación (Professor Chuntian Liu and Professor Kung-Chung Liu). Las razones de su no incorporación pasan por la consideración de la propiedad intelectual como una legislación especializada y porque allí contiene también disposiciones administrativas, lo que no encajaba bien con un cuerpo civil privado.
Entre las materias que se recogen en sus 1.260 artículos y siete títulos, encontramos (i) Principios generales, (ii) Derechos reales; (iii) Contratos; (iv) Derechos de la personalidad; (v) Matrimonio y Familia; (vi) Derecho de sucesiones; y (vii) responsabilidad civil. Su estructura sigue el modelo de la pandectística alemana del siglo XIX.
Estamos a la espera de que se publique su versión traducida al inglés para poder estudiarlo con mayor detenimiento.
