La Comisión Nacional de los Mercados y la Competencia («CNMC») ha iniciado un expediente, que podría terminar en sanción, para determinar si Amazon Spain Fulfillment es realmente un operador postal o no. Está en juego cuál es la naturaleza de la filial española del mayor operador de comercio electrónico del mundo, tal y como informa la CNMC.
El expediente, que se está tramitando la CNCM con la referencia STP/DTSP/006/20 tiene por objeto determinar si concurren los requisitos específicos para que Amazon sea considerado operador postal ya que la Dirección de Transportes y Sector Postal del regulador considera que existen indicios de que, en su actividad de comercio electrónico, Amazon presta servicios que tendrían la consideración de servicios postales.
A partir de la notificación del acuerdo de inicio del procedimiento se inicia un periodo máximo de tres meses para su instrucción y resolución por parte de la CNMC.
Para valor estas cuestiones, se tendrán en cuenta las características de los envíos que gestiona, la actividad que realiza sobre ellos, la relación jurídica que mantiene con autónomos que realizan la distribución de sus paquetes, y con terceras empresas de paquetería, y la gestión de sus taquillas autoservicio, entre otros.
¿Qué ocurriría si Amazon fuese considerado como operador postal?
Para empezar tendría que cumplir la normativa aplicable a los operadores postales, que, entre otras cuestiones, implica que éstos tengan que presentar una declaración responsable en la que, junto con la protección de derechos fundamentales como el secreto en las comunicaciones postales, incluye el respeto a las normas que protegen los derechos de los trabajadores y los usuarios y los ordenamientos en materia tributaria o de inmigración.
También conllevaría una sanción por incumplimiento de la normativa del sector de servicios postales al haber estado operando como tal.
