El Tribunal de Justicia de la Unión Europea («TJUE») regula el acceso a los documentos públicos documentos que obren en su poder actuando en ejercicio de sus funciones administrativas a través de una Decisión de fecha 26 de noviembre de 2020, cuya entrada en vigor es hoy 11 de febrero de 2020.
La Decisión se aplica a todos los documentos que obren en poder del Tribunal de Justicia de la Unión Europea, es decir, que hayan sido elaborados o recibidos por el Tribunal y se hallen en su poder. Para conceder acceso a documento de terceros en poder del TJUE deberá obtener el previo consentimiento del tercero. s
Todos los ciudadanos de la Unión Europea, así como toda persona física o jurídica que resida o tenga su domicilio social en un Estado miembro (y también aquellos Estados terceros), tendrá derecho a acceder a los documentos del Tribunal de Justicia de la Unión Europea.
Ahora bien, en ciertos casos, el TJUE denegará el acceso cuando su divulgación suponga un perjuicio para la protección (i) del interés público (seguridad pública, defensa, asuntos militares, relaciones internacionales o política financiera, monetaria o económica de un Estado miembro); (ii) la intimidad e integridad de una persona, en particular conforme a la normativa de protección de datos; (iii) los intereses comerciales de una persona física o jurídica, incluida la propiedad intelectual; (iv) los procedimientos judiciales y el asesoramiento jurídico; y (v) las actividades de inspección, investigación y auditoria.
También puede denegar el acceso en aquellos casos en los que el documento haya sido elaborado por el TJUE para su uso interno o o recibido por él y relacionado con un asunto sobre el que el Tribunal no haya tomado todavía una decisión si su divulgación perjudica grave- mente al proceso de toma de decisiones del Alto Tribunal o que contenga opiniones en el marco de las deliberaciones o consultas previas. Estas excepciones se pueden alzar por un «interés público superior» que no define.
En cualquier caso, se pueden mantener reservadas las partes del documento que atañen a las cuestiones específicas que permiten su reserva y, en cambio, divulgar el resto del documento.
Para poder acceder al documento hay que presentar un documento que recibe el director de la Biblioteca del TJUE y proceder a dar cauce al procedimiento. Cuando el documento solicitado obre en poder de la Secretaría del Tribunal de Justicia o de la Secretaría del Tribunal General, las autoridades competentes serán, respectivamente, el Secretario adjunto del Tribunal de Justicia y el Secretario adjunto del Tribunal General. La copia del documento podrá entregarse en papel o en formato electrónico.
El acceso al documento será gratuito siempre que de una consulta in situ o cuando el número de copias no sobrepase las 20 páginas. En el resto de los casos podrá solicitarse una tasa por la realización de las copias.
